Cars with Chloe (“us”, “we”, or “our”) operates the Cars with Chloe website and related services (the “Service”). This Privacy Policy is issued in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA), Canada’s Anti-Spam Legislation (CASL), and applicable provincial privacy legislation.

Personal Information We Collect

Personal Information may include your name, date of birth, home address, phone number, email address, income, employment status and details, credit history, and other information you provide through our application process.

We are committed to providing our clients, customers, and members (“you”, “your”, or “them”) with exceptional service. Providing exceptional service may involve the collection, use and, at times, the disclosure of your Personal Information. Protecting your Personal Information is one of our highest priorities.

We will inform you of why and how we collect, use and disclose Personal Information; obtain your consent, as required; and handle Personal Information according to applicable law. Our privacy commitment includes ensuring the accuracy, confidentiality, and security of your Personal Information and allowing you to request access to, and correction of, your personal information.

Purposes for Collection

We collect Personal Information only as necessary to fulfill the following purposes:

To match you with appropriate Dealer Partners for vehicle financing;
To share your application information with Dealer Partners and their affiliated lenders;
To communicate with you about your application status and financing options;
To send you transactional messages (such as verification codes and application updates);
To improve our Service and user experience through analytics;
To detect and prevent fraud;
To meet regulatory and legal requirements;
To send marketing communications where you have provided consent.

Consent

We will obtain your consent to collect, use or disclose Personal Information. In some cases, we can do so without your consent (see below). You can provide consent orally, in writing, electronically or through an authorized representative.

You provide implied consent where our purpose for collecting, using or disclosing your Personal Information would be considered obvious or reasonable in the circumstances. Consent may also be implied where you have notice and a reasonable opportunity to opt out of having your Personal Information used for marketing and you do not opt out.

By submitting an application through our Service, you expressly consent to the sharing of your Personal Information with our Dealer Partners and their affiliated lenders for the purpose of evaluating your vehicle financing options.

We may collect, use or disclose Personal Information without consent:

When permitted or required by law;
In an emergency that threatens an individual’s life, health, or personal security;
When the Personal Information is available from a public source;
When we require legal advice from a lawyer;
For the purposes of collecting a debt or protection from fraud;
Other legally established reasons.

Sharing Information with Dealer Partners

Cars with Chloe is a lead matching and referral service. When you submit an application, your Personal Information is shared with one or more independent, certified dealer partners (“Dealer Partners”) who may assist you with vehicle financing. Cars with Chloe does not pull, access, or review your credit report. However, Dealer Partners and their affiliated lenders may obtain credit reports and perform credit checks as part of their independent assessment of your financing application. Once your information is shared with a Dealer Partner, their own privacy policy governs their use of your data. We encourage you to review the privacy policies of any Dealer Partner you engage with.

We will not sell your Personal Information to unrelated third parties. We retain your Personal Information for the time necessary to fulfill the identified purposes or a legal or business purpose. We will make reasonable efforts to ensure that your Personal Information is accurate and complete. You may request correction to your Personal Information to ensure its accuracy and completeness. A request must be in writing and provide sufficient detail to identify your Personal Information and the correction being sought.

We are committed to ensuring the security of your Personal Information and may use passwords, encryption, firewalls, restricted employee access or other methods, in our discretion. We will use appropriate security measures when destroying your Personal Information such as shredding documents or deleting electronically stored information, in our discretion.

Third-Party Service Providers

We employ third-party companies and services to facilitate our Service, perform Service-related functions, and assist us in analyzing how our Service is used. These third parties have access to your Personal Information only to perform tasks on our behalf and are obligated not to disclose or use it for any other purpose. Our third-party service providers include, but are not limited to:

Analytics providers (such as Google Analytics and PostHog) for understanding how users interact with our Service;
Error monitoring services (such as Sentry) for identifying and resolving technical issues;
Phone and email verification services for fraud prevention and identity confirmation;

Log Data

We may collect information that your web browser sends whenever you visit our Service (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages and other statistics.

Cookies are files with small amounts of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your computer’s hard drive.

By providing your contact information, you consent to receive communications from us by email, text message (SMS/MMS), and telephone regarding your application, financing options, and related services. You also consent to receive occasional marketing communications from Cars with Chloe in accordance with CASL. You may opt out of receiving marketing communications at any time by following the unsubscribe link in any email, replying STOP to any text message, or by contacting us at [email protected]. Opting out of marketing messages will not affect transactional messages related to your active application. Message and data rates may apply.

Conversation Recording

Cars with Chloe and its affiliated entities may record telephone calls, text message exchanges, and other communications for quality assurance, training, dispute resolution, and compliance purposes. By communicating with us, you consent to such recording. If you do not wish to have a conversation recorded, please inform us at the beginning of the call.

Data Retention

We retain your Personal Information for as long as necessary to fulfill the purposes for which it was collected, including to satisfy any legal, accounting, or reporting requirements. Application data is generally retained for a period of up to three (3) years following your last interaction with the Service. After this period, your Personal Information will be securely deleted or anonymized. You may request deletion of your Personal Information at any time by contacting us at [email protected], subject to any legal obligations that require us to retain certain data.

Your Rights Under PIPEDA

Under PIPEDA, you have the right to:

Request access to the Personal Information we hold about you;
Request correction of any inaccurate or incomplete Personal Information;
Withdraw your consent to the collection, use, or disclosure of your Personal Information, subject to legal or contractual restrictions;
File a complaint with the Office of the Privacy Commissioner of Canada if you believe your privacy rights have been violated.

The security of your Personal Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. We have no control over, and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

Children’s Privacy

Our Service does not address anyone under the age of 18 (“Minor”).

We do not knowingly collect personally identifiable information from Minors. If you are a parent or guardian and you are aware that your Minor has provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from Minors without verification of parental consent, we take steps to remove that information from our servers.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.
